When a tow truck driver had pulled over to the side of the road to help a broken down vehicle he assumed that those driving on the road would follow the “move over” law to keep him safe, but unfortunately one vehicle did not. The tow truck driver was then hit and hospitalized. Unfortunately this type of Connecticut auto accident is far too common and it makes the job of emergency response workers significantly harder to do safely.
While this event was tragic and preventable it does offer an opportunity for us to remember what the “move over” law requires and why it is so important. As it’s name suggests, the “move over” law requires that drivers who are passing vehicles broken down on the side of the road, who are being assisted by emergency personnel or Good Samaritans, must slow down and switch lanes to give the broken down vehicle and the emergency responders as much space as possible to tend to the vehicle and it’s passengers. Failure to do so can result in a fine.
What can you do to best follow the rules laid out in the law when you are facing a situation where you’re approaching a vehicle on the side of the road?
First, you will want to slow down. It may go against your nature to slow down on the highway, but if you do it gradually you will be able to slow your speed in a safe way so as not to put yourself at risk when braking. You should not come to a complete stop unless the situation requires it. Once you see the vehicle broken down ahead, check your rearview mirror and make sure it is safe for you to slow down and then begin gradually braking.
Next, you will want to check your rearview mirror and begin your change of lanes. This is an important step as it gives the vehicle in distress and anyone assisting that vehicle the space they need to take care of the vehicle and its passengers without fear of being run off the road. Once it is clear to switch lanes, do so carefully and return to a safe speed as you drive past the broken down vehicle.
At all times during the process of moving over to follow the law and keep the folks on the side of the road safe from harm, you should avoid distractions. Do not look down at your phone or change the radio station while making the moves to keep yourself and the vehicle on the side of the road safe. Any and all distractions should be avoided all the time, but especially when you are passing a broken down vehicle.
Tow truck drivers and first responders put their lives on the line every day and the “move over” law is intended to give them safe space to do their jobs and assist others who are in need. As part of being a safe driver, you should be following this law.
As one further note, in 2017 the law was expanded to cover Good Samaritans who have pulled over to help a distressed vehicle. Even if you do not see flashing lights and a uniform, you should still follow the procedures outlined above to avoid a Connecticut auto accident.
